Why UK Companies Are Required by Law to Ensure that They Have an up to Date Employers’ Liability Insurance Policy

What’s liability insurance and particularly what’s Employers’ Liability Insurance? An Employers’ Liability Insurance policy covers you for legal costs and damages if an event arises and you or your business can be held legally accountable for it. Employers’ Culpability insurance is a mandatory insurance for the bulk of companies employing staff ( although there are some exceptions ). So what does it do and cover? If you employ staff then Employers’ Responsibility insurance is mandatory. Your insurance policy should cover at least £5 million. There’s a fine of at least £2,500 for each day a business doesn’t have the correct insurance and this law is enforceable by the Health & Safety Executive or HSE for short. It’s also an obligation to display the Employers’ Culpability Certificate obviously either in paper format or electronically, say on a employers’ intranet so staff can read this simply. This policy should cover all of your staff in Britain , Scotland, Wales & North Eire .

An worker can be outlined as a worker if they under a contract of service, if you subtract nationwide insurance and tax from their income, you control when and where they work and they can not employ a substitute when they are not able to work. To be immune from this insurance, your business shouldn’t be a limited company and you’re the only worker or you only employ close family members. If you’re a limited company and there is only worker who owns fifty percent or more of the share capital ( say your other half ) are also excepted from the mandatory employers liability insurance.

For all the other business you’ll be needed to hold this insurance policy. So what does employers’ liability insurance cover. It is an insurance policy which may meet the expenses of damages and any legal costs should a worker be wounded or get sick at work thru the responsibility of the employer. For instance if a worker has an accident and suffers an injury thru the failure of their employer, ie flawed machinery or not providing safety appliances. The insurance policy won’t only cover the price of damages, compensation and legal costs but will also cover the NHS costs for surgery treatment and the ambulance costs which is claimed when a private injury compensation claim is paid.
